TELEMEDICINE CONSENT AND MEDICAL DISCLAIMER

This Telemedicine Consent and Medical Disclaimer ("Consent") applies to your use of teleconsultation services offered through the PaxEM Health platform, comprising the website(s) at paxemhealth.com, paxem.health and paxemhealth.ai and the PaxEM Health mobile application (the "Platform"), owned and operated by Future Path Health Private Limited ("PaxEM", "we", "us", "our"). Please read this Consent carefully before booking a teleconsultation. By proceeding to book a teleconsultation on the Platform, you confirm that you have read, understood, and agree to this Consent.
1. Not for Medical Emergencies: This Platform, and the teleconsultation services offered through it, are not intended for use in a medical emergency. If you are experiencing a medical emergency, including but not limited to chest pain, difficulty breathing, severe bleeding, loss of consciousness, or any condition that may be life-threatening, please immediately call your local emergency services or visit the nearest hospital emergency department. Do not rely on the Platform for emergency medical care.
2. Nature of the Services: A teleconsultation booked through the Platform is a consultation between you and an independent, registered medical practitioner ("Doctor") conducted by video, audio, or text chat, as you select at the time of booking. The Doctor is registered with a State Medical Council and/or the National Medical Commission of India and must follow the Telemedicine Practice Guidelines, 2020 issued by the Government of India. The Doctor may, at their professional discretion, decline, discontinue, postpone, or reschedule a teleconsultation if it is clinically inappropriate, legally restricted, ethically impermissible, or otherwise not feasible to provide care through telemedicine.
3. Identity Verification: PaxEM or the Doctor may request you to verify your identity before or during a teleconsultation to comply with applicable laws, confirm your identity, or ensure patient safety. Failure to complete such verification may result in the consultation being declined, postponed, or cancelled.
4. Role of PaxEM: PaxEM is a technology platform that facilitates the booking, scheduling, and conduct of teleconsultations between you and independent Doctors. PaxEM is not a healthcare provider, does not employ or supervise the professional medical judgment of Doctors listed on the Platform, and does not itself provide any medical advice, diagnosis, or treatment. All medical advice, diagnosis, treatment, and prescriptions are provided solely by the treating Doctor in the exercise of independent professional judgment. PaxEM does not guarantee the availability of any Doctor or the outcome or success of any consultation, diagnosis, treatment, prescription, or medical advice provided through the Platform. Booking a teleconsultation does not by itself create a doctor-patient relationship. Such relationship arises only when the Doctor accepts and commences the consultation. You also authorise PaxEM to make your consultation details and relevant medical records available to your treating Doctor for the purpose of providing healthcare services.
5. Recording by Users: Neither you nor the Doctor shall record, reproduce, publish, transmit, distribute, or otherwise disclose any teleconsultation, in whole or in part, without the prior written consent of the other party, except where such recording or disclosure is required by applicable law.
6. Consultation Modes and Recording: Teleconsultations may be conducted via video, audio, or chat, as made available on the Platform. PaxEM does not currently record video or audio teleconsultations. If this changes in the future, you will be separately informed and your consent sought before any such recording takes place.
7. E-Prescriptions: Where a Doctor issues a prescription following a teleconsultation, it will be issued electronically, bearing the Doctor's name, medical registration number, and a valid digital/electronic signature. In accordance with the Telemedicine Practice Guidelines, 2020, certain categories of medicines (including those listed under Schedule X of the Drugs and Cosmetics Rules, 1945) cannot be prescribed through a teleconsultation, and the Doctor may accordingly recommend an in-person consultation where necessary. The validity and use of any prescription issued during a teleconsultation shall remain subject to the Doctor's clinical judgment, applicable law, and the medical condition being treated. The Doctor may require an in-person consultation before issuing or renewing any prescription where clinically or legally necessary
8. AI-Assisted Tools: During your consultation, the Doctor may use certain AI-assisted tools made available on the Platform (such as AI-supported differential diagnosis, drug-interaction checking, or medical-scribing tools) to assist the Doctor's own assessment. These tools are clinical decision-support tools for the Doctor only; they do not diagnose or treat you, and all clinical decisions remain solely those of the Doctor. Where your information, including consultation content, is processed using such tools, such processing shall be governed by PaxEM's Consent for Collection of Health Data and Privacy Policy, both of which you are required to review and accept before your information is processed in this manner.
9. Third-Party Services: Certain features of the Platform may rely on third-party service providers, including payment gateways, video conferencing providers, cloud hosting providers, messaging or OTP providers, mapping services, and similar technology partners. PaxEM is not responsible for any interruption, delay, or failure attributable to such third-party services.
10. Limitations of Teleconsultation: A teleconsultation does not involve a physical examination, and there may be conditions that cannot be adequately assessed or treated remotely. The Doctor may, at their professional discretion, determine that your condition requires an in-person examination, diagnostic investigations, specialist referral, or emergency medical attention, and may decline to proceed with or complete a teleconsultation on that basis. You agree to follow the Doctor's advice in such circumstances. You acknowledge that telemedicine has inherent limitations when compared with an in-person consultation and may not be suitable for every medical condition.
11. Technology and Connectivity: Your teleconsultation depends upon your device, internet connectivity, and the proper functioning of the Platform. PaxEM will use commercially reasonable efforts to maintain the availability of the Platform; however, temporary interruptions may occur due to scheduled maintenance, software updates, security enhancements, technical upgrades, or circumstances beyond PaxEM's reasonable control. You are responsible for ensuring that you have a compatible device, a functioning camera and microphone (where applicable), a stable internet connection, and a reasonably private environment suitable for a confidential medical consultation. You are also encouraged to use a secure internet connection and avoid accessing teleconsultation services over unsecured public Wi-Fi networks. Where a teleconsultation is disrupted due to a technical failure attributable to the Platform, you will be entitled to a reschedule or refund in accordance with PaxEM's Cancellation & Refund Policy.
12. Eligibility: You confirm that you are at least eighteen (18) years of age and are booking this teleconsultation for yourself. As of the date of this Consent, the Platform does not support booking of teleconsultations on behalf of minors or dependents.
13. Your Responsibilities: You agree to provide accurate, complete, and up-to-date information regarding your medical history, symptoms, current medications, allergies, and any other information reasonably required by the Doctor. You also agree to promptly inform the Doctor of any material change in your condition during the consultation or where reasonably relevant to your ongoing treatment. Incomplete, inaccurate, or misleading information may adversely affect the quality of medical care. Where the Doctor recommends a follow-up consultation, diagnostic investigation, in-person examination, or any other medical review within a specified period, you agree to comply with such advice to ensure continuity and quality of care. You further consent to receiving appointment confirmations, consultation links, reminders, prescriptions, medical reports, invoices, and other communications relating to your teleconsultation electronically through the Platform, email, SMS, or other electronic means.
14. Misuse of the Platform: You agree not to impersonate any person, provide false or misleading medical information, upload inaccurate or fraudulent medical records, misuse prescriptions issued through the Platform, or engage in abusive, threatening, or inappropriate conduct towards any Doctor or PaxEM personnel. PaxEM reserves the right to suspend or terminate access to the Platform in the event of any such misuse.
15. Grievances: If you have any concern regarding a teleconsultation or this Consent, you may contact PaxEM's Grievance Officer at: Name: Gopinath Surey, Contact Details: Gopinathsurey@gmail.com. Nothing in this Consent restricts your right to lodge a complaint against a Doctor before the appropriate State Medical Council, National Medical Commission, or any other competent statutory authority, where permitted under applicable law.
16. Force Majeure: PaxEM shall not be liable for any delay, interruption, or failure in providing the Platform or teleconsultation services arising from events beyond its reasonable control, including internet or telecommunications failures, cyberattacks, cloud service disruptions, governmental actions, public health emergencies, natural disasters, pandemics, or other force majeure events.
17. Governing Law: This Consent is governed by the laws of India, and is to be read together with PaxEM's Terms of Service and Privacy Policy.
